These Terms and Conditions ("Terms") govern your use of the Elacara platform ("Platform"), operated by Elacara Ltd.

By creating an account or using the Platform, you agree to these Terms.
1. About Elacara
Elacara is an online marketplace that connects customers with independent businesses offering services including but not limited to:
- Clothing alterations and tailoring
- Shoe and leather repairs
- Laundry and dry cleaning
- Jewellery and watch services
- Key cutting and locksmith services
- Embroidery, printing and customisation
- Home textile and furnishing services
- Other repair, restoration and care services
Elacara facilitates bookings, payments and communication but does not generally provide these services itself unless expressly stated.
2. Marketplace Role
Elacara acts solely as an intermediary platform.
Unless expressly stated otherwise:
- Elacara is not the provider of the services.
- Contracts for services are formed directly between Customers and Businesses.
- Elacara is not a party to those contracts.
Businesses operate independently and are responsible for the services they provide.
3. Business Independence
Businesses using the Platform are independent contractors.
Each Business is solely responsible for:
- Pricing
- Service quality
- Workmanship
- Turnaround times
- Insurance
- Compliance with applicable laws
- Any licences or qualifications required
Elacara may perform verification checks but does not guarantee the quality, suitability or outcome of any service.
4. User Accounts
You agree to:
- Provide accurate information.
- Keep login details secure.
- Keep contact information up to date.
- Use the Platform lawfully.
We may suspend or terminate accounts that breach these Terms or any Platform policies.
5. Bookings
A booking request does not create a contract until accepted by the Business.
Businesses may accept or decline bookings at their discretion.
Customers are responsible for ensuring that:
- Item descriptions are accurate.
- Photographs are clear.
- Measurements and instructions are correct.
Businesses may request additional information before accepting a booking.
6. Revised Quotes
If a Business discovers that an item differs materially from the original description or requires additional work:
- Work may be paused.
- A revised quote may be submitted.
- The Customer must approve the revised quote before work continues.
If the revised quote is declined, the booking may be cancelled.
Return postage charges may apply.
7. Payments
Payments are securely processed through Stripe or another authorised payment provider.
Businesses may set their own prices.
The Platform may charge fees or commissions.
Payment processing is subject to the terms and conditions of our payment providers.
Where applicable, customer funds may be temporarily held until the booking is completed.
8. Cancellations and Refunds
Customers may cancel bookings before work begins, subject to the applicable cancellation policy.
Once work has commenced, cancellations may not be possible except where required by law.
Refund requests will be assessed in accordance with our Refund Policy.
9. Collection, Delivery and Postal Services
Customers are responsible for securely packaging items before shipment.
Businesses should use reasonable care when handling customer property.
Elacara is not responsible for:
- Courier delays
- Lost parcels
- Damage occurring during transit
- Third-party delivery services
Responsibility for shipping may depend on which party arranged the shipment.
10. Uncollected Items
Businesses should make reasonable attempts to contact Customers regarding collection.
Items left uncollected for an extended period may become subject to storage charges or other procedures set out in Platform policies.
11. Service Results
Many services involve working with used, aged or delicate materials.
Customers acknowledge that:
- Exact outcomes cannot always be guaranteed.
- Cleaning may reveal hidden defects.
- Alterations may be limited by garment construction.
- Existing wear or fabric weakness may affect results.
Businesses are expected to use reasonable skill and care but cannot guarantee perfect results.
12. Customer Responsibilities
Customers agree to:
- Provide accurate information.
- Remove valuables from items.
- Respond promptly to requests for information.
- Pay approved charges.
- Attend fittings where required.
Customers remain responsible for incorrect measurements or inaccurate descriptions they provide.
13. Business Responsibilities
Businesses agree to:
- Perform services professionally.
- Communicate honestly.
- Meet agreed service standards where reasonably possible.
- Maintain any required insurance.
- Handle customer property with reasonable care.
14. Reviews
Customers may leave reviews after completed bookings.
Reviews must be truthful and must not contain:
- False information
- Defamatory content
- Abuse or harassment
- Illegal material
Review manipulation or extortion is prohibited.
15. Acceptable Use
You must not:
- Commit fraud.
- Create fake accounts.
- Make fake bookings.
- Circumvent Platform payments.
- Harass other users.
- Upload malicious software.
- Engage in illegal activity.
- Arrange Platform bookings outside the Platform.
Elacara may suspend or terminate accounts for breaches.
16. Privacy and Data Protection
We process personal data in accordance with UK GDPR and our Privacy Policy.
Business users may receive customer contact details solely for the purpose of fulfilling bookings.
Personal data must not be used for unauthorised marketing.
User data is stored using Supabase and other approved service providers.
17. Third-Party Services
The Platform relies on third-party providers including payment processors and cloud infrastructure services.
Their own terms and privacy policies may apply.
18. Intellectual Property
All Platform content, branding, logos and software are owned by or licensed to Elacara Ltd.
You may not copy, distribute or exploit Platform content without permission.
19. Limitation of Liability
To the fullest extent permitted by law, Elacara Ltd shall not be liable for:
- The quality of services provided by Businesses.
- Damage to customer items.
- Loss of items.
- Courier failures.
- Delays.
- Disputes between Customers and Businesses.
- Indirect or consequential losses.
- Loss of profits, business opportunities or goodwill.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
20. Dispute Resolution
Elacara may assist in resolving disputes but is not obliged to do so.
We may review messages, photographs, tracking information and other evidence.
Any decisions made by the Platform regarding refunds or payment holds are at our reasonable discretion.
21. Suspension and Termination
We may suspend or terminate accounts where:
- These Terms are breached.
- Fraud is suspected.
- Illegal activity is identified.
- Platform security is threatened.
Users may request account closure by contacting us.
22. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
23. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales unless consumer protection law provides otherwise.
